Motorcyclist Crashes In A Car Passing Maneuver...............video footage [message #780389] Sat, 15 July 2006 16:45

This was an accident captured by another Motorcycle following wit a
camera. A Motorcycle is attempting to pass a car on a country hwy, but
the car in front of him is trying to do the same. This looks so typical
and ended in a bad crash. The Quiz Question here is, who's fault would
you say is this ?

The biker - he rode straight into the back of the car. Also his road
positioning was appalling .

The rider caused that accident, he was crap.

The bike rider was definately at fault. The car signal can clearly be
seen at 3 seconds into the clip. Thats about two signal flashes
before the rider decided to get into the car.

Mind you, I don't think I would have been trying to overtake if I was
the car driver. It looked to tight. But I'm a blind old git so who
cares? :)

FACT!
The car pulled into the riders path.

As such, it is without a doubt the car drivers fault.
The car driver should have checked his mirror before pulling out.
Putting your indicator on does not give you the right to change road
position.

The motorcycle rider was crap however and should have seen it coming.

Sure, but the rider should have reacted to it. Other road users *are*
going to do stupid things. The fact that the rider may have been in the
right doesn't really help him when he's lying crumpled in the ditch.

Absolutely.

Incidentally, it looks to me as though the following rider (the one with
the camera) was looking to overtake at the same time, and doesn't really
react either (apart from avoiding the faller). Is he level with the car
when the first bike goes down?

Hmm. The motorcyclist was trying to get away from the police (or whoever was
taking to video) and the car driver wasn't paying enough attention, being
too interested in what was in front of him and now noticing what was behind.
I wonder if this was a police chase and if the sirens were on.

No, the car indicated and pulled out at the same time as the bike did
AFAICT. The car did indicate, though I'm not sure when; the bike most
certainly didn't. At the point when the car driver started his
manoeuvre the bike was not overtaking.

Additionally, given that the bike approached at some speed, then if
the car driver looked, he'd probalby have seem the bike initially
further back. It's harder to judge speeds in rear view mirrors.

It's almost certainly mostly the biker's fault. It's still possible
that the driver didn't look, but by no means a certainty and even so,
the bike was too fast too close to do anything about it.

The only mitigating circumstances from the biker's POV were that the
car driver could've anticipated the bike overtaking, as it's common
bike behaviour.

And the car *was* signalling. Doesn't mean he checked his mirrors though,
which he apparently didn't.

6 of one, half a dozen of the other, I'd say.
