Hi,
21 days after paying for an item I "won" the seller emails me asking if I
got it because the post office in Philadelphia has called him as they had a
damaged package with no delivery address left on it. In that first
communication he states that he has had the post office send it back to him
acting like he wasn't really sure what it was. I wrote back and said no I
hadn't got it but since I used pay pal I assumed he had used something to
prove delivery. He says he used delivery conformation and tracking and do
not worry he had refunded me.
The Item (approx. $300 and quite durable) had closed quite low as that type
of thing goes, actually exceptionally low as I really expected to be outbid.
I did get the money back but it shows up as unpaid in my ebay now. I really
expect this is a non selling seller and unless he gives me a tracking # to
plug into www.usps.com and see it got as far Philadelphia and went back to
him I will think I got my time wasted. I kind of think he deserves a non
selling seller strike but he has feedback # in the 900's with only one
neutral. This situation must happen a bunch and doesn't really fit into
their non selling seller mold. I wonder If I have any business asking for a
tracking # but kind of would like for ebay to ask for it. Yes he is still
capable of giving me neg.
Does anyone know who is supposed to get the goods and deal with the shipper
for a claim. Does anyone really think the post office would call on the
phone in this situation? It would seem since I paid for the item and he
shipped it I should get the damaged box with contents and any $ from the
insurance if the contents were really hurt inside. Some posters here seem
to be giving advice that the seller should let or make the buyer deal with
the shipper and exactly how to make sure they have all the info they need to
do so.

Fran,
File a non delivery with Paypal or ebay. You should have done this after
you calculated the seller had money in hand. You did not say whether it was
a Paypal transaction, personal check, or money order.
You said you got your money back, why spend any more heartbeats? File a
negative on the seller. If the seller files a negative on you, contact
ebay. Sellers "should" in my opinion, send positive feedback when they
receive payment for the transaction. Anything else is not amenable to
repeat commerce.
Go lurk at Alt.marketing.online.ebay for more opinions.

You even said there was supposedly no deliver address. They could very
well go to that minor inconvenience if they had limited info.
