| Motorcycle accident opinion [message #471370] |

I was in a motorcycle accident and I'd like to get a few opinions if anyone
would be so kind.
I was traveling on a city street at about 30 MPH (close to the posted speed)
As I approached a side street I saw a van pull up to the stop sign, I made
eye contact with the driver and she seem to see me.
Then she floored it and started to bolt across the street.
I was very close and had to start hard braking.
I though she would clear my path by the time I reached the position but
suddenly she slammed on the brakes directly in my path. I have no idea why,
perhaps she saw a car coming in the other lane.
The sudden stop on her part caused me to flinch and I gripped the brakes
hard and started to skid.
The bike went into a slide and I lost control and went down. I broke my
right leg as the bike landed on it.
What do you think about this accident in terms of who is at fault?

I think if you didn't slow down instinctively for the upcoming intersection you
should probably give up riding.

Is this a trick question? She had a stop sign. She couldn't enter the
intersection until it was clear.

It must be painfully obvious...you had the right of way, and now you
need to find a good lawyer and exercise your rights.
What did the other driver offer to compensate you?

seems like she was a fault for stopping in front of you and
blocking your lane.
she ran the stop sign...
sue the hell out of her for your loss & suffering..

The way they write them now I would say you might be at fault
5 percent with her at fault 95 percent or more.
Who got citations and what were they for?

Seeing her face in her mirror is not enough, every intersection is a
prime source for getting killed, always approach intersections with your
clutch and brake covered, assume the car will jump in front of you. I
think in order to learn to drive a car one must learn how to drive a
motorcycle first. You stated you went down because you braked to hard.
Stay off the back brake so hard. Keep riding and put it behind you.

If it happened as described, then legally the driver of the van was
clearly at fault. She had a stop sign and the responsibility to avoid
oncoming traffic, ie you, before pulling out. Were tickets issued? If
this wound up in court, you would have an excellent chance of winning.
However, as others have pointed out, driving defensively might have
prevented the collision. You said you started to brake hard, thought
she would be out of the way by the time you got there, but then she
stopped and you braked so hard you skidded. Sounds to me like you
didn;t really brake all that hard to begin with, only enough to slow
sufficiently to give her some room to clear. When she stopped, you had
to then really brake hard and wound up skidding.

Given this very sketchy minimal information (sure you don't want to
add more?), you don't say if you hit the van, if she stopped, or
whatever. Only experience I had in this type of situation was I was
running 40 in a 35 and an old lady pulled out in front of me. I sped
up, almost got around her, but clipped her front bumper, knocking her
frame 30 degrees askew. Totalled her car, I went down, did the
ambulance routine, got sewed up, & was back home for supper (a late
one to be sure).
IMO, there are no rules that cover every situation, but in my case, I
saw her, and was ready for her. If I'd have tried to stop, I'd have
nailed her with my body, rather than flying off my bike. I'd say the
last thing you'd have wanted was a direct impact with the cage.
Maybe, just maybe, you could consider yourself fortunate that you
weren't hurt worse.
It's a coinkidense, but Monday, I take the Experienced Rider course.

This talk should be part of every Rider Course, sadly it's not.
My brain has said, "I ain't got time to explain - SLAM ON
THE BRAKES!" so many times now, it's a game to see how fast my
conscience can figure out what it is. Girl - cell phone - 2 o'clock
Looking right through me! Good catch brain.
